Information Commissioner v Experian Ltd [2024] UKUT 105 (AAC) (22 April 2024)


The Information Commissioner issued an Enforcement Notice against Experian in respect of its data processing - The First Tier Tribunal for the most part allowed Experian's appeal against this regulatory action - The Information Commissioner appealed to the Upper Tribunal against the First Tier Tribunal's decision - The grounds of appeal primarily concerned the principle of transparency, being both the overarching duty in General Data Protection Regulation Article (GDPR) 5(1)(a) and the more detailed obligations under GDPR Article 14 - Adequacy of reasons - Information Commissioner's appeal dismissed.
